No requirement for County Registrar to sign Family Law Declarations
It has come to the attention of the Conveyancing Committee and the Family Law Committee that solicitors are submitting Family Law Declarations to the County Registrar in the context of Divorce Orders when the transfer document is being signed by the County Registrar under Section 14(5) of the Family Law (Divorce) Act 1996.
It is the view of both Committees that it is not appropriate for a County Registrar to be requested to sign a Family Law Declaration. The County Registrar does not have the requisite knowledge to sign such a Declaration.
