Revised Certificate of Title documentation - 2011 edition for residential mortgage lending

Practitioners should note that a new edition of the Law Society’s Certificate of Title documentation was drafted last year, in consultation with the IBF, to reflect changes in the law brought about by the Civil Partnership and Certain Rights and Obligations of Cohabitants Act 2010, and to update the list of participating lenders and the reference in the documentation to PII legislation. The new edition – the 2011 edition – has an effective date of 2 April 2012 and will be used by participating lenders for all loans approved on or after that date.

The Society has provided the participating lenders with the text of the new edition, to allow them print stocks of the new edition in advance of the effective date for inclusion in solicitors’ packs in respect of loans approved on, or after, 2 April 2012
