The President of the District Court has advised the Litigation Committee that, in an effort to streamline the processing of applications, new procedures are to be introduced on an experimental basis. Checklists in respect of filing requirements and time limits for the full range of applications are set out hereunder.

ANNUAL LICENSING COURT - CHECKLISTS

CLUBS

  1. Application signed by the Chairman or Secretary stating the name and object of the club and the address of the premises occupied by the Club are lodged not less than 21 days before the Annual Licensing Court.
  2. Two copies of the rules of the Club.
  3. List of names and addresses of the officials and committee of management or governing body.
  4. List of members of the Club.
  5. Statutory certificate of two Peace Commissioners (not Commissioners for Oaths).
  6. Declaration of service on the Fire Officer at least one month prior to the Licensing Court.
  7. Copy of newspaper published not less than 21 days before the annual Licensing Court. The full page of the paper (including the date at the top) should be filed.

RESTAURANT CERTIFICATES

  1. Application, lodged not less than 4 days before Annual Licensing Court.
  2. Declaration of service not less than 10 days prior to the Annual Licensing Court on the Garda Superintendent.

DANCE LICENCES

  1. Application, lodged 7 days before the Court.
  2. Declaration of service on
  3. (a) the Garda Superintendent at least one month.

    (b) the Fire Authority at least one month or such lesser period as they agree.

    (c) the local authority at least one month.

  4. Copy of newspaper published not less than one month before the Court.

GENERAL EXEMPTION ORDER

  1. Application lodged at least 48 hours before the Court.
  2. Declaration of Service on the Garda Superintendent not less than 7 days.

MUSIC AND SINGING LICENCES

  1. Application lodged not less than 14 days prior to the Annual Licensing Court.
  2. Declaration of service on
  1.  
    1. the Garda Superintendent not less than 14 days prior to the Court.
    2. the Fire Authority not less than one month or such lesser period as they agree.

CONFIRMATION OF TRANSFER

  1. 21 days notice of application lodged with the Licensing Office.
  2. Declaration of service, 21 days notice to the Superintendent Garda Siochana and one month to the Fire Office.
  3. Original licence with ad interim transfer endorsed.
  4. Newspaper published not less than 21 days or more than 35 days in the case of on licences and not less than 2 weeks and not more than 4 weeks in the case of off licences.

OBJECTIONS

  1. 21 days notice to Licence Holder.
  2. 10 days notice to the Licensing Office.
  3. Declaration of service.

The Committee believes that adherence to the guidelines will operate in ease of the Court, practitioners and clients.
