Health board delays in Children’s Court

Certain portions of the Children Act, 2001 were brought into effect by way of a commencement order (SI 151 of 2002). A section which is of particular relevance to those practitioners dealing with childcare is section 267(1)(a). This section amends section 17(2) of the Child Care Act, 1991, which only authorised the District Court to make or extend an interim care order for more than eight days with parental consent.

Section 267(1)(a) states that the District Court can now make an interim care order or extend that order for a period of 28 days in the absence of parental consent.
