Constitution for owners’ management companies post 1 June 2015
The Conveyancing Committee has issued a precedent form of memorandum and articles of association for an owners’ management company (OMC) under the . It is available on the Law Society website under Precedents (no. 22). However, this precedent will no longer be appropriate for use in incorporating new OMCs following the commencement date for the , anticipated to be 1 June 2015. Practitioners currently setting up schemes for new multi-unit developments might consider having the OMC incorporated before that date.
The committee is arranging to have drafted a precedent constitution for an OMC under the Companies Act 2014 that will comply with the Multi-Unit Developments Act 2011 and will publish it on the Law Society’s website as soon as it is available.
